When a Montana PE stamp is required

The Montana Board of Professional Engineers and Professional Land Surveyors, part of the Department of Labor and Industry, licenses engineers under Title 37, Chapter 67 of the Montana Code. Commercial buildings, multifamily buildings of five or more units, and other work under the state building code need engineering where the design is not prescriptive. The project address controls the license: an out-of-state PE cannot seal a Billings, Missoula, or Bozeman permit set.

State law exempts residential buildings with fewer than five dwelling units, farm and ranch buildings, and private garages from the state building code unless the local government makes the code apply to them. Many certified cities do. Typical triggers include commercial structure, tenant work that changes a load path, retaining walls, and MEP the building official will not accept unsigned. AllInStamp matches a Montana-licensed PE and verifies the license before sealing.

The Building Codes Program and certified local jurisdictions

The Building Codes Program in the Department of Labor and Industry adopts the codes for the whole state. ARM 24.301.131 adopts the 2021 International Building Code with Appendix C for agricultural buildings. Cities, counties, and towns may enforce only codes the program has adopted, may not adopt anything more stringent, and must have their enforcement program certified by the state. Areas without a certified program fall under the state program’s own permits and inspections.

Certified jurisdictions include Billings, Missoula and Missoula County, Bozeman, Great Falls, Helena, Kalispell, Whitefish, Belgrade, and Butte-Silver Bow. Some certified programs cover only building, or only residential or commercial work, and the state keeps the rest. The state fire prevention and investigation section of the Department of Justice also reviews building plans for conformity with state rules. Name the city or county in the quote so the set goes to the right office.

The seal and signature under ARM 24.183.511

The seal may be an embossing seal, a rubber stamp, or a digital seal. It contains the licensee’s name, the license number in the form #####PE, and the legend “Professional Engineer.” The authorized sizes are a 1-5/8-inch pocket seal, a 2-inch desk seal, and a 2-inch rubber stamp, and a digital seal may be reduced to one-half of the original size. The seal and signature must reproduce legibly on every copy of the final drawings.

The title page of all plans and documents filed with public authorities bears the seal and original signature of the licensee in responsible charge. The board’s rules define a signature as either an original manual signature or the licensee’s digital equivalent, and a digital seal may be used on plans, specifications, and reports. Montana licensing guidance also expects engineers to date sealed sheets and revisions, so the dated signature belongs on the set.

How to get a Montana set sealed

Upload the PDF plan set and calculations, name the certified city or county or say the site is under the state program, and note the occupancy and number of dwelling units. Include the ground snow load and geotechnical criteria the design used. Out-of-state drawings can be reviewed, and the seal is applied only by a Montana licensee in responsible charge of the work.

FAQ

Does Montana’s building code apply to single-family homes?
Not by default. State law exempts residential buildings with fewer than five dwelling units unless the city, county, or town makes the code apply. Many certified jurisdictions do, so check with the local building department.
Does Montana accept digital seals on PDF drawings?
Yes. ARM 24.183.511 allows a digital seal, reduced to as little as half the original size, and the board’s rules count a digital equivalent of the licensee’s signature as a signature.
Can a PE licensed in another state stamp Montana drawings?
No. Montana permit work is sealed by a Montana licensee. Engineers licensed elsewhere apply to the board for a license by comity under ARM 24.183.701. AllInStamp routes Montana jobs to Montana licensees.
