Is online PE stamping legal?

Remote review is allowed. What state boards prohibit is sealing work the engineer never took responsible charge of.

Online PE stamping

What state boards actually allow

Every U.S. state lets a licensed professional engineer review work prepared by someone else and seal it, as long as the engineer is in responsible charge. Responsible charge means the PE directed the engineering decisions or reviewed them closely enough to take legal responsibility. The review can happen remotely. The statutes care about the license and the review, not about whether the PDF was emailed.

The license has to be active in the state where the project is permitted. Comity and an out-of-state license do not let an engineer seal a set for a state they are not licensed in. Online PE stamping does not create an exception to that rule.

What the building department checks

Plan check looks up the license, confirms the discipline matches the sheets, and checks that the seal, signature, and date follow that board’s electronic-seal rules. They also review the engineering itself. A valid seal gets you into review. It does not skip review.

Bring the adopted code edition, local amendments, and any prior comment letter with the upload. The cleaner that package is, the fewer comments come back after the seal is on it.

FAQ

Can an engineer stamp plans they did not draw?
Yes, if they review the plans thoroughly enough to take responsible charge and they are licensed in the project state. The review is the work. The seal records it.
Does the engineer have to visit the site?
Not for a typical permit review of drawings and calculations. A site visit is a different scope. Say so at intake if the building department or the project needs one.
